General Terms and Conditions

(1) These General Terms and Conditions (GTC) apply to the use of the online platform Nimmdas (hereinafter Platform), operated by Car Trade23 GmbH, Landstraße 3a, 4470 Enns, FN 614578 t, Landesgericht Steyr (hereinafter Operator).

(2) The Platform provides an online marketplace on which registered users can offer and search for goods and services. The Operator itself is not a party to the purchase contracts concluded between users.

(3) By registering, the user accepts these GTC. Deviating terms of the user are not recognised unless the Operator expressly agrees to their validity in writing.

(1) Registration is required to use certain features. The user must provide truthful information.

(2) Each user may create only one user account.

(3) The user is responsible for keeping their login credentials confidential and is liable for all activities under their account.

(4) The minimum age for registration is 18 years. Minors aged 14 and over may only use the Platform with the consent of a parent or legal guardian.

(5) The Operator reserves the right to block or delete user accounts without prior notice in the event of a breach of these GTC.

(1) Listings must be truthful and complete. Misleading information about price, condition or characteristics is prohibited.

(2) The following content is prohibited:

• Illegal goods and services
• Weapons, drugs, counterfeit products
• Pornographic content or content glorifying violence
• Content that infringes copyrights or trademark rights
• Spam, chain letters, pyramid schemes
• Discriminatory, offensive or inflammatory content

(3) The user grants the Operator a non-exclusive, free-of-charge right to use the uploaded content (texts, images) for the purpose of displaying it on the Platform.

(4) Listings have a limited duration and are automatically deactivated once it expires.

(5) The Operator reserves the right to remove listings without giving reasons if they violate these GTC.

(1) Users undertake to comply with the applicable laws of the Republic of Austria and the EU.

(2) In particular, it is prohibited to:

• Use the Platform for unlawful purposes
• Provide false or misleading information
• Harass or threaten other users
• Carry out automated access (bots, scrapers) without permission
• Manipulate the Platform or endanger its security
• Send spam messages

(3) The user is liable for all content uploaded by them and indemnifies the Operator against third-party claims.

(1) Nimmdas is an intermediary and not a contracting party to transactions between users. The Operator gives no guarantee as to the accuracy, completeness or quality of the listings posted.

(2) To the extent permitted by law, the Operator is not liable for damage arising from the use of the Platform. This applies in particular to:

• Incorrect or fraudulent listings by other users
• Transactions that fail to materialise or are defective
• Temporary unavailability of the Platform
• Data loss due to technical faults

(3) In cases of intent and gross negligence, the Operator is liable in accordance with the statutory provisions. Otherwise, liability is limited to foreseeable damage typical for this type of contract.

(1) The messaging function serves exclusively for communication about listings. Spam, advertising and unsolicited contact are prohibited.

(2) Reviews must be truthful and objective. Insults, false statements and abusive reviews may be removed.

(3) The Operator is entitled to view messages and reviews for moderation purposes and, where necessary, to delete them.

(1) All rights to the Platform, including design, logo, texts and software, are held by the Operator or its licensors.

(2) Use of the Platform does not grant the user any right to the Operator's intellectual property.

(1) The user can delete their account at any time.

(2) The Operator may terminate the user relationship without notice for good cause, in particular in the event of breaches of these GTC.

(3) Upon termination, all of the user's active listings are deactivated.

(1) The Operator reserves the right to amend these GTC at any time. The user will be informed of any changes.

(2) If the user does not object to the amended GTC within 30 days of receiving the notification, the new GTC are deemed accepted.

(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For consumers within the meaning of the KSchG, the mandatory provisions of the Konsumentenschutzgesetz (Austrian Consumer Protection Act) apply. The place of jurisdiction for consumers is the consumer's place of residence.

(3) For businesses, the place of jurisdiction is Steyr, Austria.
